How long can I wait before filing an injury lawsuit in Washington?

Washington generally gives injured people three years to file a personal injury lawsuit. That deadline comes from RCW 4.16.080, which covers claims for injury to a person or personal rights. A claim can become much harder to pursue if that date passes, so it is better to review the case early.

Can I still bring a claim if I may have contributed to the accident?

Yes. Washington does not automatically block an injured person from recovery just because they share some fault. Under RCW 4.22.005, any recovery may be reduced by the percentage of fault assigned to that person. For example, if the insurer says you were partly responsible, a Vancouver personal injury attorney can push back with evidence.

What can a Vancouver personal injury lawyer pursue for me?

A claim may include medical bills, future care, missed income, reduced ability to work, pain, disability, scarring, emotional distress, and other losses tied to the accident. Washington law distinguishes between financial losses and personal harm in RCW 48.140.010, which addresses economic and non-economic damages.

Does the process change if a public agency caused my injury?

Yes. Claims involving the City of Vancouver, Clark County, or another local government may require a formal claim before a lawsuit can be filed. Under RCW 4.96.020, the claim must usually be presented to the appropriate government representative, and a waiting period applies before suit may be filed.

What if the driver who hit me has very little insurance?

Washington’s required minimum auto coverage is limited. The state lists the minimums as $25,000 for one injured person, $50,000 for injury or death to two or more people, and $10,000 for property damage. If those limits do not cover the loss, uninsured or underinsured motorist coverage may be added to the claim.
